As we are all aware&lt;font size="4"&gt;, &lt;font color="#ff0000"&gt;Chelene Nightingale&lt;/font&gt;&lt;/font&gt; is truly California&amp;#8217;s only hope with respects to &lt;u&gt;securing our borders&lt;/u&gt;, &lt;u&gt;protecting State&amp;#8217;s rights&lt;/u&gt;, &lt;u&gt;bringing back an&lt;/u&gt; &lt;u&gt;education system from the brink of disaster&lt;/u&gt;, and most importantly, &lt;u&gt;BRINGING&lt;/u&gt; &lt;u&gt;BACK CONSTITUTIONAL PRINCIPLES TO GOVERNMENT&lt;/u&gt;!&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;Chelene Nightingale and this campaign NEEDS YOU SUPPORT NOW MORE THAN EVER. One of the MOST IMPORTANT things to do right now for Chelene Nightingale and this campaign is to register into the &amp;#8220;American Independent Party&amp;#8221; if you are not already a member. With the primaries closing in fast, Chelene NEEDS all the AIP signatures she can get to place her on the ballot. Re-registering into the &amp;#8220;American Independent Party&amp;#8221; and signing the petition which allows Chelene Nightingale to be on the ballot is the most IMPORTANT step in her campaign. This will ensure that SHE IS the constitutional candidate in the California General Election come this November. &lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;&lt;p&gt;&lt;u&gt;REGION: Caltrans, Minutemen dispute finally over &lt;/u&gt;&lt;/p&gt;&lt;p&gt;&lt;u&gt;Agency pays up, installs new sign and publicly apologizes&lt;/u&gt;&lt;/p&gt;&lt;p&gt;&amp;#160;&lt;/p&gt;&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;The new freeway signs are up, the money's been paid, and the apology has been publicly made. It appears that almost two years after it started, the battle between the San Diego Minutemen and the California Department of Transportation is over.&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;"It does appear that the agency met all of its obligations," Jeff Schwilk, founder of the local Minutemen group, said Wednesday. "We feel vindicated. ... Let's hope we learned lessons from this and let free speech be free speech."&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;The tug of war over free speech issues started in January 2008 when the state agency yanked its OK for the anti-illegal-immigration activist group to post its name on freeway cleanup signs near a busy U.S. Border Patrol checkpoint in North County. It ended in a court settlement.&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;But turning agreements into action took a little prodding from a federal judge, who two weeks ago ordered the agency to make good on settlement promises with the controversial group.&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;Caltrans on Monday installed a second Adopt-A-Highway cleanup sign along Interstate 5 bearing the Minutemen's new logo. And last week, the agency made good on an agreement to issue a specifically worded public apology.&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;Caltrans has also turned over a $157,000 check it cut as part of a settlement with the group.&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;"We have complied with the court order," Caltrans spokesman Edward Cartegena said Wednesday.&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;The Minutemen sued Caltrans in federal court last year after the agency reneged on giving the group an Adopt-a-Highway cleanup sign near the busy San Onofre immigration checkpoint.&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;The group argued its constitutional rights to free speech, free expression, equal protection and due process were violated when Caltrans stripped away the signs.&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;The agency said it feared confrontations along the busy roadway and offered to move the Minutemen's sponsorship to a remote location near Santee. The Minutemen said Caltrans was bowing to political pressure: The state Latino Legislative Caucus and immigrants-rights activists had urged that the permit be revoked.&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;When the case was settled during talks mediated by a federal judge three months ago, Caltrans agreed to pay up, apologize and get the activist group a second sign advertising its volunteer trash pickup efforts along the freeway.&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;But when it didn't happen fast enough, the Minutemen complained to the federal court.&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;So on Oct. 27, U.S. District Judge William Q. Hayes told Caltrans it had 14 days to act on what it had already agreed to do.&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;In issuing the order, Hayes also rejected a request to give some of the $157,000 settlement money to a woman who had successfully sued Schwilk personally for defamation-related allegations. The woman, Joanne Yoon, had unsuccessfully argued that Schwilk and the San Diego Minutemen were one and the same.&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;Yoon has now taken her request to get a cut of the money to the state court judge who oversaw the trial that Yoon won this summer.&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;Schwilk said that his activist group should net about $97,000 of the settlement, with the balance going to pay the remaining fees to the attorneys who represented the Minutemen in the battle with Caltrans.&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;By TERI FIGUEROA - tfigueroa@nctimes.com&lt;/strong&gt; &lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;font size="5"&gt;'Empathy' in action'&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;Thomas Sowell - Syndicated Columnist - 5/27/2009 10:05:00 AM&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;It is one of the signs of our times that so many in the media are focusing on the life story of Judge Sonia Sotomayor, President Obama's nominee for the Supreme Court of the United States.&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;You might think that this was some kind of popularity contest, instead of a weighty decision about someone whose impact on the fundamental law of the nation will extend for decades after Barack Obama has come and gone.&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;Much is being made of the fact that Sonia Sotomayor had to struggle to rise in the world. But stop and think.&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;If you were going to have open heart surgery, would you want to be operated on by a surgeon who was chosen because he had to struggle to get where he is or by the best surgeon you could find -- even if he was born with a silver spoon in his mouth and had every advantage that money and social position could offer?&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;If it were you who was going to be lying on that operating table with his heart cut open, you wouldn't give a plug nickel about somebody's struggle or somebody else's privileges.&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;The Supreme Court of the United States is in effect operating on the heart of our nation -- the Constitution and the statutes and government policies that all of us must live under.&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4" color="#ff6600"&gt;Barack Obama's repeated claim that a Supreme Court justice should have "empathy" with various groups has raised red flags that we ignore at our peril -- and at the peril of our children and grandchildren.&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;"Empathy" for particular groups can be reconciled with "equal justice under law"-- the motto over the entrance to the Supreme Court-- only with smooth words. But not in reality. President Obama used those smooth words in introducing Judge &lt;font color="#ff6600"&gt;Sotomayor but words do not change realities.&lt;/font&gt;&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4" color="#ff6600"&gt;&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4" color="#ff6600"&gt;Nothing demonstrates the fatal dangers from judicial "empathy" more than Judge Sotomayor's decision in a 2008 case involving firemen who took an exam for promotion. After the racial mix of those who passed that test turned out to be predominantly white, with only a few blacks and Hispanics, the results were thrown out.&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;When this action by the local civil service authorities was taken to court and eventually reached the 2nd Circuit Court of Appeals, &lt;font color="#ff6600"&gt;Judge Sotomayor did not give the case even the courtesy of a spelling out of the issues. She backed those who threw out the test results. Apparently she didn't&lt;/font&gt;&lt;font color="#ff6600"&gt; have "empathy" with those predominantly white males who had been cheated out of promotions they had earned.&lt;/font&gt;&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;Fellow 2nd Circuit Court judge Jose Cabranes commented on the short shrift given to the serious issues in this case. It so happens that he too is Hispanic, but apparently he does not decide legal issues on the basis of "empathy" or lack thereof.&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;&lt;u&gt;This was not an isolated matter for Judge&lt;/u&gt; &lt;u&gt;Sotomayor&lt;/u&gt;. Speaking at the University of California at Berkeley in 2001, &lt;font color="#ff0000"&gt;she said that the ethnicity and sex of a judge "may and will make a difference in our judging."&lt;/font&gt;&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;Moreover, this was not something she lamented. On the contrary, she added, &lt;font color="#ff0000"&gt;"I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn't lived that life."&lt;/font&gt;&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;No doubt the political spinmasters will try to spin this to mean something innocent. But &lt;font color="#ff6600"&gt;the cold fact is that this is a poisonous doctrine for any judge, much less a justice of the Supreme Court.&lt;/font&gt;&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;That kind of empathy would for all practical purposes repeal the 14th Amendment to the Constitution of the United States, which guarantees "equal protection of the laws" to all Americans.&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4" color="#ff6600"&gt;&lt;u&gt;What would the political spinmasters say if some white man said that a white male would more often reach a better conclusion than a Hispanic female?&lt;/u&gt;&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;font size="4"&gt;For those who believe in the rule of law, Barack Obama used the words "rule of law" in introducing his nominee. I removed 55 pounds of litter from public lands for the day. So far for the past five days, I have averaged 50 pounds of litter removal each day(up from a normal 25 -30 pounds per day).&lt;BR&gt;&lt;BR&gt;It never ends! &lt;DIV class=storybyline style="MARGIN: 0pt 0pt 15px; COLOR: rgb(153,153,153)! important"&gt;&lt;STRONG&gt;&lt;FONT color=darkgoldenrod&gt;By Anna Gorman, Los Angeles Times Staff Writer &lt;BR&gt;June 22, 2008 &lt;/FONT&gt;&lt;/STRONG&gt;&lt;/DIV&gt;&lt;STRONG&gt;&lt;FONT color=darkgoldenrod&gt;About 50 protesters marched in downtown Los Angeles on Saturday to decry violence by illegal immigrants and to demand that the Los Angeles Police Department change its controversial policy limiting when someone can be questioned about their immigration status. &lt;BR&gt;&lt;BR&gt;The marchers, including anti-illegal-immigration Minutemen and local community activists, also called for justice for Jamiel Shaw II, 17, a black athlete who was shot and killed in March by an alleged gang member who was in the country illegally.&lt;BR&gt;&lt;BR&gt;&lt;/FONT&gt;&lt;/STRONG&gt;
&lt;DIV style="CLEAR: left; FONT-SIZE: 1px"&gt;&amp;nbsp;&lt;/DIV&gt;&lt;STRONG&gt;&lt;FONT color=darkgoldenrod&gt;They carried American flags and signs that read, "Justice for Jamiel".&lt;BR&gt;&lt;BR&gt;A few dozen counter-protesters walked alongside the crowd, shouting, "racists" and accusing the marchers of being Ku Klux Klan members. They held a large Mexican flag and chanted, "No human being is illegal." &lt;BR&gt;&lt;BR&gt;A line of uniformed officers separated the groups, which remained peaceful despite heated verbal confrontations.&lt;BR&gt;&lt;BR&gt;The march and rally at City Hall comes days after a judge ruled that Pedro Espinoza, 19, will stand trial in Shaw's slaying.&lt;BR&gt;&lt;BR&gt;Shaw's father, Jamiel Shaw, walked at the front of the protest, wearing a shirt with a photo of his son and the words, "An illegal gang banger killed me."&lt;BR&gt;&lt;BR&gt;"This guy just happened to be in the neighborhood and wanted to kill black people," Shaw said.&lt;BR&gt;&lt;BR&gt;A few steps behind, protester and local attorney Sam Zislman said the slaying showed that the LAPD needs to reform its long-standing policy, Special Order 40, that prohibits officers from initiating contact with people simply to determine whether they are illegal immigrants.&lt;BR&gt;&lt;BR&gt;Zislman and others are pushing a change called "Jamiel's Law" that would allow LAPD officers to routinely check the immigration status of known gang members who are suspected of committing a crime.&lt;BR&gt;&lt;BR&gt;Zislman said police should be using "every possible tool" to detain illegal immigrants, especially known criminals and gang members.&lt;BR&gt;&lt;BR&gt;But counter-protesters, including Najee Ali, argue that the slaying had nothing to do with race, but instead was gang-related. Evidence in last week's preliminary hearing showed that Jamiel Shaw II may have been associated with a gang at war with a rival group.&lt;BR&gt;&lt;BR&gt;During the march, Ali held up a photo of Shaw flashing gang signs and said the family is trying to use the slaying to push their own anti-illegal immigrant political agenda. &lt;BR&gt;&lt;BR&gt;"This was not a hate crime," said Ali, founder of Project Islamic Hope. "They are allowing their son's death to racially divide the city even more."&lt;BR&gt;&lt;BR&gt;The case is part of a larger debate over the role of race in homicides in the area. Los Angeles County Sheriff Lee Baca has said that race is at the heart of the gang problem. On the other side, LAPD Chief William J.
